What are the essential elements the court looks for in determing if a partnership exists?

The court would turn its attention to Florida's Uniform Partnership Act and the elements set forth in the Act, facts that would indicate the parties had a partnership agreement, the course of dealing between the parties and any and all relevant documentation that would flush out the truth about the facts of the case. Get yourself a lawyer and good luck.

An agreement, oral or written to share profits & losses of a business and proof of such agreement.
