Legal Question in Business Law in Florida
payment for work partialy complete
as a company we subcontract to a cable provider, doing installations of residential properties.they run quality checks on our work and bill backcharges on missed items on the install, often to the rate of 8 or 9 times what we billed for the entire job in the first place. for e.g missed label tags and a missed filter can run $90 on a job we billed $25 for even though it is only approx 10% of the total job. i thought there was a law which says they could backcharge a percentage of the job, but would still owe for the percentage of work completed. in our contract we are supposed to have 24 hours to fix NON service related problems, however, we are not notified of discrepancies until after they have been fixed by the cable co

Re: payment for work partialy complete
An accurate reply can be provided only after a review of your contract is completed. As a major installer, I am a bit surprised that you do not have a company atty who can perform that task.
In most situations notice of defect and an opportunity to cure are standard provisions. It seems the cable co. is attempting to intimidate you.
The dispute is of substantial proportion and may very well be determined by a court. I urge you to consult with a competent creditors' rights atty.
