Predispute Waiver of Jury Trial
My wife is being asked by her potentially new employer to sign a form that waives her right to a jury trial in liue of arbitration. The exact wording is ''I understand that by signing this agreement I am giving up my right to a jury trial.''
Is this an enforceable agreement? Is it just a jury trial that she is waiving but can still use the court system. Can they really keep her from pursuing litigation by the court system for things like sexual harassment, discrimination, and compensation?
