That is too big of a question to be summed-up in a paragraph or two. You do need a lawyer, and you do need paid legal advice. If I can be of service, feel free to send me an email directly.
You should consult with an attorney for specific legal advice. There is also useful information at the copyright office's website and the USPTO's website. Regards,
You can visit my website and review the law guides in this area and if you need specific legal help you can contact me by e-mail or phone. My website address is Florida LegalServicesOnline.com.
The short answer is - probably not. Even the business idea you say is not new, only new to the community. What you will face is something called competition. Now you may want to consider packaging your business concept so you can sell it to possible competitors, either as a business opportunity or as a franchise. Consult a franchise attorney.
