Legal Question in Business Law in Florida

Registering a Corporation

If I plan to open a business specificly for scooter advertising, but plan to expand in the years to come, can I register the corporation as one name and then register for a ficticous name which I will use on a daily basis? Example: Mobile Media Expressions will be the name of the primary company, but because I will start with scooters, I would like to use Scooter Expressions as the name for the business, with the option to expand later.

Yes, provided the fictitious name is not already in use.

I would also consider filing for a federal trademark either on an existing use basis or intent to use basis. Of course, the name might be too descriptive or already in use so you might want to contact an experienced trademark attorney that can walk you thru the name selection. The last thing you want to do is dump a bunch of money into a business name in advertising dollars only to have to change it later if you are infringing on someone else's trademark. Remember that a fictitious name filing doesn't provide any level of protection. Your rights come from use. Hope this helps.
