Legal Question in Business Law in Florida
Required license for business not located within City limits
I own a limo company and I have paid my occupational tax in the municipality where my business is located. I frequently receive business calls, and subsequently customers, from a nearby municipality. I am being told that in order to pick up my clients in my limo, charge them for my driver and the use of my limo, and return them to their home, in the municipality different than that which I hold my occupational license, I am required to pay for an occupational license to do business in their municipality. Is this legal? What if I pay the county an occupational tax license to do business within the county, but the municipality is located wholly within the county? Can they still require me to purchase an occupational tax license if my primary business is located outside of their jurisdiction, but I occasionally do business within their geographical borders?

Of course, cities can and often will require you to get a license if you do business within their jurisdiction. Many businesses have multiple licenses if they transact business in different jurisdictions.
