Restocking Fees

Hello,

I am being charged a re-stocking fee on a defective item that I bought from a reseller. The company policy online does not state that there are re-stocking fees for defective items.

Is this a legal practice?

A restocking fee would have to be disclosed in order for it to be charged to you. If you purchased the item online, be sure that you read all of the "fine print" including the terms and conditions that you agreed to when you clicked through the vendor's website. If you purchased the item at a store (or from a catalog), be sure you read all of the contract terms (in a catalog those terms may be on a different page from the order page).
