Name Rights

I just read Incorporatin and Name rights. I have almost the same problem. I filled under a X Inc dba Y but am listed as X Inc on the State site also! Another corporation filed after I did (2 monthes) and uses the name Y Inc. The difference in our situations is they have on filed for a federal trademark but they have not been accepted. They are being held up because of other companies with the name Y. I have not been contacted my their assisinged attorney. Will I be or do I have to contact them. I have not opened my store yet, I am still inthe proces of getting inventory and the building. I have used the name for my business plan, SBA financing and S-Corporation status with the IRS. My papers from them shows X Inc dba Y. Can I use the Y name or do I ahve to use the full X Inc dba Y and how do I find out about trademark rights? Do I have any agianst the other company? They are in business.
