Legal Question in Business Law in Florida
Seizure of Bank accounts follow-up question
Original Question:
I recently defaulted on my companys (a LLC) lease agreement, can my landlord seize or block my business and\or my personal bank account without my knowledge? If so, how long would that normally take?
Answer:
No. If your LLC was properly formed and properly operated, your personal accounts and assets should be fine (assuming that you did not sign a personal guarantee). There would need to be a law suit before anything could be seized.
Follow-up questions:
I did sign a 12-month Personal Guarantee, so in that case can they seize the bank accounts.
And
Can they seize the business bank accounts?
Would they need to file a lawsuit in those cases as well?

Re: Seizure of Bank accounts follow-up question
They cannot seize the bank accounts without a judgment against you. That would require a law suit.
