If I sign a non compete for 6 months after employment and within a 50 mile radious, then go to work for a company outside the 50 mile radious but work from home which is within the 50 mile radious am I violating the non compete?

Unfortunately the answer would be, it depends. Non-competition agreements limit your ability to work within a specific area to prevent you from using client lists, suppliers, etc in the area you were familiar with while employed with that company. This circumstance may depend on the type of work that you are doing from home and how it ties in with what you did with your previous employer. Either way, your previous employer may try to prevent you from working from home on this job, but you may have a reasonable defense depending upon your type of work performed.
