Re: signiture fraud for business

Additional information was provided to me. For the benefit of others, the situation is:

The questioner is a woman who married a Canadian citizen and lived with her step-son. The step-son asked for her social security number, she gave it to him, and the step-son opened a construction business (an entity, but not clear which type) without her knowledge using her name and signature on all the documents. She signed no documents, and never had any involvement in or even knowledge of the business. All documents were forged with her signature. Now, she and the Canadian husband are going to get divorced. He has money and she has none, so she is looking for any way possible to obtain a favorable settlement. She believes the business her step-son opened with her signature was profitable, and she wants a piece of it. She thinks, but does not know, that the money her soon-to-be-ex has can be attributed to the business of her step-son.

I told her she needs a divorce attorney to sort through the mess and determine what assets she may be entitled to. She also needs a business law attorney to sort-out the business mess, and at the very least have her name removed from the business licenses/registrations.

So, any takers on the divorce issue or the business issue? I merely advised her that she needs to find an attorney and will not be involved further.

I do not understand the situation.

You opened a business with your step-son or he opened a business with your name without your knowledge? Did you sign the initial documents for company formation or not? Did you just find out about the business and everything after the fact? Or is the fact that you signed the initial company documents, but did not sign some "business contract" afterward? Let me know what type of business entity too.

You need to clarify before I can have any idea of the situation here, let alone tell you what you can/not do.
