Legal Question in Business Law in Florida
I am a small business owner in Florida. I am the pblisher of a local magazine. Upon opening the business about a year ago I signed a non-compete and a trial "area" publishers agreement, with a company that solicited for "area" publishers. The company sent me an official "Area" publishers agreement once my first magazine was printed and distributed. (which I signed) Within that agreement is also a non compete which is different from the original that I signed. Since then the Company that I signed with has done some reconsructing, the printer is still the same but the distribution company they were going through has changed. They have requested I sign a NEW non compete and Area publishers agreement, in which I have refused. My current contract is with them, not the printer or distribution company they go through. The company has since threatened me, financially, mentally, and emotionally. This was happening before the changes they made, but really has become unbearable to the point, I pray not to hear from them. I guess my question is why are they trying so hard to get me to sign another non compete and publishers agreement? And is there anyway I can break free of this company and not be liable for the non compete?

Without seeing the agreements, it is impossible to speculate. You should consult with an attorney to weigh your options.
I am sorry to hear about your situation. I cannot answer your questions without seeing the contracts. Have you asked them why there is a need for a new non-compete? Also, what does your termination clause in your contract with them state? Feel free to call me if you would like further assistance.
