Legal Question in Business Law in Florida

my son had some work done on his car and I received a phone call from the auto shop stating that my son need to bring the car in right away because he (the mechanic) left an important part off the car, but when he got there the mechanic reveals that he really didn't leave a part off the car but my son owned more money for the work that was done. The shop will not return the car back to him until he pays the amount owed. As far as the payment, my son was under the impression that the work was paid in full. My concern is the unethical business practice of this company and what can be done about it.

While this is totally outside my area, I thought you may want to consider this. Since the car had already left the shop with their permission, and they detained it upon false premise, I wonder if it may be a crime. I would suggest you check with the police and ask them.

As a Franchise Attorney I agree with the other attorney's suggestion. A call to your local police department may be very productive. Consult with a good business or franchise attorney in your area for specific advice.
