Legal Question in Business Law in Florida
Name spelled wrong
I had a business contract with
Wachovia. On the contract they spelled
my first name wrong. They also
notarized it 3 days later not in my
presence. I was 400 miles away. Is the
contract legal?

Misspelling your name is probably not significant. You probably should report the notary to the governor's office (the Florida governor directly regulates notaries). If the notary is invalid, your contract may be invalid, depending on the type of contract. You should show the contract to a lawyer to learn if your contract is still valid with an invalid notary stamp.

Yes. The misspelling is irrelevant. Unless the contract was required to be notarized (very few are), that improper notary will be irrelevant as well.
