Legal Question in Business Law in Florida

Starting tutoring business

I am a certified teacher wanting to start an in home tutoring business. Is it absolutely necessary to purchase insurance in regards to child liability for in my home, or would it be legally safe and appropriate to have parents sign some type of legal form of waiver that eliminates risk to me in regards to child liability. I am hoping to start this up with little to no cost and also be legally safe. thank you for your help!

No state law reqiuires insurance for tutoring in your home. In fact, you are probably covered by your homeowner's insurance for accidents, and you may want to check to see if there are exclusions for home businesses.

Your city and/or county may require insurance, though, and you may want to call them to check.

Check with a lawyer regarding liability waivers, since the law is changing in that area as I write this.

It is not "absolutely necessary" to have insurance. It is smart, but not necessary. There is some dispute at present about whether parents can sign a waiver of the type you envision on behalf of their minor children. Even if they can, there are exceptions to waivers so you may not ever be completely protected. The best thing to do is have insurance. Your homeowners insurance may already provide coverage, but you should check with them about that and whether there is an exclusion since you will be operating a business.
