Legal Question in Business Law in Florida
Statute of Limitations on work obligation
4 years ago I produced videos for businesses. I reached an oral agreement with a business to produce a video for them. They gave me an agreed upon deposit of 50% of the total cost of the production of the video. The company decided to postpone the production of the video indefinitely. 2 years ago I stopped producing videos and work now full-time as a software engineer. The company contacted me recently (approx 3 1/2 years after our initial agreement) and wanted to proceed with the video. Do I have any legal obligation to refund their deposit or produce their video?

The previous reply is accurate. As a direct reply, the s/l probably will act as a full defense for you if suit is commenced.
Re: Statute of Limitations on work obligation
It's completely unreasonable and even absurd for the business to expect you to return a deposit which may not even cover the work that you had already performed several years ago. In fact, you may be owed money, depending on the agreement you made. Unless you agreed to return the deposit if the video was not fully produced, even if the same was requested by the business, then you should be fine.
If the business elected to stop the project and requested that you not continue working on the production of the video, it cannot simply sit on its hands for years and then come knocking expecting you to continue working on a dead project or return money that was rightfully earned years earlier. Unless your verbal agreement contemplated an interruption of several years, and that you would commence working on the project again immediately upon request for the same rate of pay, I don't think you have much to worry about. Of course, the work product may belong to your former client. Seek the advice of counsel and good luck.
