Telemarketing Fraud
My mother (age 76) was contacted by a Florida company who promised to sell her timeshares. She signed a contract and gave them $3,600. She changed her mind and canceled in the 3-day grace period. When they received the cancelation, they called and told her they had two checks from buyers and that she needed to resend the contract. She did, but only because they said they had the checks. They said this on three occasions. The company now denies saying this and will not give her any compensation. The company is not registered in Florida that I can find--can they conduct business in Florida? What kind of proof do we need to show--this is really ''he said, she said'' at this point...any help?

This question poses many needed addition facts to answer. Like where does your mother live,does she have documentation (even handwritten notes)to assert her position,who is the timeshare co,what were dates of her payment,etc.If you want to persue I would suggest you call or e-mail my office tomorrow.(9/25/06)
