Telephone directory error

We just received the new yellow page telephone directory and the agent put in the wrong number on our big ($1000/month) display ad. For some reason it is listed with an old area code. If you dial that number, first there is a long distance toll charge (scaring off potential callers) and secondly the line does not connect to anything (as if I have gone out of business). When we discussed the ad copy with the agent , she assured us that it would be corrected. It was not! In addition to losing potential business, do we need to pay for their error?

Every issue of yellow pages directories contains errors. The publisher knows that its customers will not receive the full value of the listing if errors appear. They will negotiate a settlement with you. I would take the position that you shouldnt have to pay anything. Unfortunately, you have no cause of action against them. The disclaimer that appears has bee found to be valid. Check with your own lawyer before relying on my opinion!
