Trademark Infringment/Dilution

I am part of a company(Inc.) that has a previous employee who resigned form the company, and now has a new company with the same name, registered as an LLC and doing the same business while taking clients. For sending a cease/desist letter i was called by a relative of his and was told id be physically harmed if i kept on doing business as (Inc.)

What legal rights do I have to ensure that these people are brought to justice over the threats and trademark infringement?

Your company should speak to an attorney right away and file a civil action against this new company.

The former employee may be liable for misappropriation of trade secrets, tortious interference with contractual or advantageous business relationships, or other civil causes of action. As for the threats of physical harm, that is a criminal matter for the police to handle. You can contact the police or the local state attorneys' office to report those threats. Also, you may be able to get a temporary restraining order to prevent them from contacting you or approaching you.
