Legal Question in Business Law in Florida

Unlicensed lawyer practicing in business

Is is lawful for a New Zealand lawyer who moved to Florida to practice business law for pay? She has been hired by my former company and is making legal documents, etc., including my termination agreement document. This person is not licensed in Florida.

Re: Unlicensed lawyer practicing in business

It appears that the The New Zealand lawyer is practicing law without a license, and that is illegal. You can contact The Florida Bar in Tallahassee and report this matter.

No, it appears that such lawyer is not a licensed attorney in Florida and therefore cannot practice law (prepare documents, etc.). Contact the Florida Bar - Miami Office (305) 377-4445.

Re: Unlicensed lawyer practicing in business

The New Zealand attorney may be admitted to another state as an attorney and therefore eligible to work as an in-house counsel in FLorida. All in-house counsel must register with the Florida Bar. If you go to: http://www.flabar.org/tfbtemplates.nsf/newwebsite?openframeset&frame=content&src=/TFB/TFBLawReg.nsf/e0f40af2c23904c785256709006a3713/c3bb720da00c570885256b2f006c62cd?OpenDocument

you can get a list of attorneys registered (alphabetically) as in-house counsel. Attorneys licensed in other jurisdictions are allowed to take on certain legal tasks as in-house counsel. If your person is not on the list, then most likely that person is practicing without a license and should be reported to the Florida Bar.
