Unpaid final pay check

I worked for a small business for

about 18 months without a written

employment contract. When I got

fired I was told that my final pay

check would be given to me as soon

as they had been paid for the large

job we had been doing. After 5

months I was told payment had

been recieved and my check was in

the mail. It never arrived. The

company has since told me I was a

sub contractor to them but I worked

there more than 40 hrs a week for

the 18 months. What do I do to get

paid?

It sounds like you will have to take them to court. Get an attorney if the amount is above what you could get in small claims.

You can file a complaint with the US Department of Labor. If they investigate it costs you nothing. If they refuse, you can hire and attorney to write a letter or file a suit for you if the amount in question warrants it. Generally, employment claims include a reasonable attorney's fee and court costs.
