Legal Question in Business Law in Florida
What can wife and husband legally do in this case?
Husband and wife are married.
They started a business store #1
TOGETHER 7 years ago. Business
grew, now they have 2 stores.
Husband takes care of one store,
wife takes care of another store.
Because of irreconcile differences,
wife files for divorce. Wife wants to
take over part of the business, one
of the stores. The thing is the
business is under husband's name,
all bank account info in relationship
is under husband name. It is a
salon business, the nature of their
business, the wife is always there,
she pretty much helped build the
business because she is there all
the time. Husband just comes and
collect the money at the end of the
day. What can the husband do to
claim it all? What can the wife do to
claim her part of ownership?

The business, as you describe it, sounds like marital property and will be subject to division by the divorce court.

If the parties cannot work out a settlement agreement, the court will during the divorce proceeding.
