I work at a comic book shop in florida, my boss recently started threatening to deduct an hours worth of pay from us for each customer that isn't called and informed their order has arrived for the day. Can he do this? It causes no loss to the store, as someone remembers to call them the next day if it was forgotten.

As a follow up, if it is illegal to dock someones pay for an honest mistake with no monetary loss to the store, can I inform my boss that this is illegal without worrying about him firing me? I would imagine that if your employer is threatening something that isn't legal, he shouldn't be able to fire you right?

Florida is an at-will employment state. This means that your boss can fire you for any reason or no reason at any moment with no notice at all. Alternatively, you can quit at any moments notice as well.

That being said, your employer cannot refuse to pay a non-salaried employee for hours that the employee has worked. However, your employer is not prohibited from reducing a nonexempt worker�s hourly wage rate as a disciplinary action. Nonexempt employees only have to be paid the minimum wage.
