Legal Question in Business Law in Florida

If I work for a company as a sales person selling services (ie internet marketing services) and the company does not actually provide the services paid for to the customer. Do I hold any responsibility for the companies behavior?

As a Franchise Attorney I would say the answer depends on how you are employed. If you are an employee, then it would be very difficult to hold you responsible. On the other hand, if you are an independent contractor, then you can be held to be an agent of the company and liable on agency theory. Note: an increasing number of employers try to skirt their tax withholding, social security, etc. responsibilities by using "independent contracts" who are really employees. If this is the case, contact your state's local employment development or labor department. Consult with a good business or franchise attorney in your area for specific advice.
