Cell Phone detained by school

I am a sophomore in high school. My cell phone was heard when another student set it's ringer off. The teacher took it and sent it to the office. When I went to retrieve it they would not give it back. They say they will not give it back until my parents come and get it. This is a problem because my parents both work before and after my school office hours. I want to know if it is legal to detain my property when I was not using it illegaly or attempting to.

Have your parents call the school. Many school's do not permit cell phones.
