Legal Question in Civil Rights Law in Florida
Getting someone declared mentally incompetent.
The mother of my children is mentally incompetent,unstable and provides an unhealthy living environment for my children to function in. We are divorced, the children live with her nearby and the children suffer as a result of being with her. How can I get her a court ordered mental competency test for her and as a result of the test, get her institutionalized?

Inasmuch as the court deems itself to be in loco parentis to any child it has jurisdiction over, you can petition the court for a change of custody and present as much evidence as you can garner, including taking depositions of your ex, as well as psychologists or psychiatrists. This is not a matter you should attempt to handle yourself, seek legal counsel in your community.
