Legal Question in Civil Rights Law in Florida

down here in florida, "ocean rescue" is under the fire dept down here in the south florida, my question is: may someone that works for ocean rescue tell anyone that they are required to leave the BEACH for only using a camcorder and/or DSLR camera. This person was not getting closer then about 10feet to what they were shooting. They were not doing anything other then walking up and down the beach, using this equipment to record what was on the beach in plain view of the general public. The area was by the waters edge, ocean, on south beach ocean drive from 5th-14th street or so. off the waters edge from five feet to about 50feet or so.

Yes, they may tell you to stop doing anything. Whether they are right or not is for a court to decide. If you were filming boobs on South Beach, no judge is going to side with you.

Consider yourself lucky you didn't get a ticket or get the camcorder confiscated. Kicking you off the beach is the nicest thing they could have done [I would have given you a non-law-enforcement lesson on no voyeurism, and you would not have left with that camera or all your limbs in tact].

Too bad, so sad. Next time, film the water and birds -- not the T&A.
