I'm not entirely sure what you are asking, but it sounds like you want to know if you can record someone on the phone without that person's knowledge or consent. The answer is no. Even if someone else secretly recorded you, it is illegal to record someone on the phone without their knowledge/consent. It is a felony known as "wire-tapping" for non-law enforcement personnel to surreptitiously record a person's phone conversation.
