Re: Do state agencies have immunity in Federal court?

The 11th amendment only bars certain (not all) suits against state agencies. It does not bar actions against local government such as cities and counties, including sheriffs' departments.

However, suing any government entity is fraught with procedural issues and there may be other immunities or difficulties that you face, although the 11th amendment should not be one of them.

Good luck.
