It depends entirely on how that is done. If done pursuant to a discovery request, that is perfectly legal. If it with a hidden camera in a private home where someone has an expectation of personal privacy, it may be an invasion of privacy and be inadmissible.

It is possible to waive the expectation of privacy by inviting people into your home, but that may not always mean that surreptitious tape recording or videotaping would be lawful.

State laws vary and Florida may have a specific statute on this issue.

As a general rule it is not a good idea to conduct videotaping inside someone's house without their permission.

You should consult an attorney in Florida and disclose all relevant facts about what you wish to use the evidence for before proceeding with any videotaping.
