Legal Question in Civil Rights Law in Florida
My wife and I had a verbal arggument in miami-dade county and a neighbor called the department of childrens service. They sent a lady out and all kinds of questions that had nothing to do with the safety of my daughter and looked at my daughter to make sure she was ok. She was of course! then about a month later another weird lady shows up and says she is trying to close the case and needs to see my daughter again right away. She also asks for date of birth and my social to do a background check. I have nothing to hide, but I don't understand why the need to probe for questions not related to the safety of my daughter. I am also concerened with the comments made by the DCS investigator about my daughters breast being so developed and how I should be worried about letting her out of the house. These investigators just do not seam to be very poffessional. Can I file a harrasment order against them to make them stop?

Once you get yourselves into the child protective services system (by having a fight that attracts the attention of a neighbor), you must play by their rules. If you believe that the DCS investigator was out of line, you can speak to her supervisor, but they are checking to see if you are a child molester, sex offender or felon, to determine whether or not your daughter is in danger. You would be smart to go along, to get your case closed, and then keep peace in your family, so that you don't have this agency investigating you again.
