I was employed at a software company where I left my company to become a contracted reseller. I was using a gmail address ([email protected]) I used this email account to host my own company account.
One day I accidentally reset my gmail account and had forgotten I had my secondary email to my old employer account. Needless to say my exboss stoled my email and refuses to give it back.
I have email exchange if him admitting he took my gmail account. Can I sue?

If you used the email "excompany@gmail" to do business for your own company, you were wrong in doing so, and your ex-employer has not stolen anything. I don't know what you mean by "reset" the gmail account (to not forward to your other email? to allow an old password?).
In any event, if you are not damaged in a legally compensable way, you have no case. I would hope that the ex-employer does not have a cause of action against you for tortious interference, unfair competition, and/or breach of a non-compete agreement. You may be the one in trouble here.
