In order for a text message to be publicly released do both the recipient and sender need to consent, or a person with access to the message?

This is really a BS question because it all depends upon the context. Are you talking about hearsay and admissibility in court? Are you talking about privacy rights? What are the facts surrounding the question?

No. If you text someone, they are free to provide it to whomever they want. If you wisper in someone's ear, they can repeat it to anyone they want. If you write a note, they can pass it along.
