I gave my ex sister in law a picture frame and some recipe cards, I am staying at her house, but I will be leaving and I want the stuff. back I intend to take them back without telling her would that be considered theft

I doubt you need a lawyer to give you the answer. You gave her something. It is hers now, no different than if she had purchased them herself.
I suggest that you kindly let her know how much they mean to you now that the relationship is "ex". It may be the case that she cares less for them now.

It would indeed. A gift belongs to the recipient, not the person who gave it. You have no more right to take these items than anyone else would.
