Legal Question in Construction Law in Florida

Building Permit

My father-in-law is 82 years old. He hired a shutter company to place accordion shutters on his house. The contract said that the shutter company would apply for the permit. He required 50% down and 50% upon completion. He is now finished and he never did apply for a permit. My father-in-law is holding back $1000.00 until a permit is applied for. He already paid this man over $8700.00. What should he now do?

RESPONSE: I would write the shutter company a letter requesting that they pull the permit, and upon passing any inspections and closing out the permit, that you will release final payment.
