Legal Question in Construction Law in Florida
canceled check
We had a builder build a house on our land. He did shotty work on the cabinets and the shower tile. We brought this to his attention and he refused to fix it. Then he locked us out of the house. When the house was finished he stuck us with a 25,000 overage, with 22,000 that we weren't aware of and didn't approve. He knew that we needed to be out of the house that we were renting and the only way he would let us move in was to write him a check. He was fully aware that we didn't have the money and we would have to get another loan. After we were denied for the extra money. We decided we needed to consult an attorney and didn't feel we should have to pay for work that was not done, not done right, or wasn't approved by us. The contract stated that any and all overages needed to be signed by all parties. Since then he paced a lien on our house and lied about the date we moved in since he only has 90 days to do so. Now he's filed a lawsuit for triple the check amount. What can I do?

Passing a bad check is very serious and you should have consulted an attorney before you did it. You need ot get in touch with a construction attorney that also can deal with the check issue. ASAP
