do notice to owner requirements apply when the owner of the construction company you contract with is also a principal in the corporation owning the real estate being improved? We deal with him directly and he cannot claim he has no knowledge of us.

This gets complicated, but there is a theory that is known as the alternate identity doctrine and which would be a defense to the failure to serve a notice to owner. However, it will depend on more thorough review of your facts.
