Construction Lien

I need to know the procedure for filing a construction lein, and where to get a notice to owner form.

Most of the forms that you can buy in the store, and which I have seen, have not been updated to include recent revisions to the Florida Statutes. Florida Statute section 713.08 has the form to be used for filing a claim of lien. But if you have never done this before, there are many pit falls for the unwarry, that may cause your lien to be deemed a fraudulent lien or slander of title if you do not file the lien correctly, and which may result in heavy liability against the lienor. Accordingly, I highly recommend you contact a local attorney to educate you on the process.

There are forms available through the local contractor associations and there are companies who you can pay a small amount of money to simply file the lien. But it would be a good idea to have an attorney help you with the first few so that you become familar with the procedures. I have helped clients set up the procedures and forms for their office and provide practical knowledge of the statute.
