contractor not paying sub contractor

We subcontract through a contractor . we recieved a letter from him stating that to keep him from going bankrupt, he would only be paying 45% of the invoices we have outstanding with him. We know that he is receiving full payment from the builders for the work that we completed and billed for. what can we do to get the rest of the money owed to us.

You can sue him. What he is doing is attempting to create a contractual obligation on your part to only accept partial payment as a full and final settlement of the debt. If you accept the money, that may be considered an acceptance of his terms.

If you sue him, you can get a judgment against him and have the ability to divert monies paid to him directly to you.
