Fraud against the court

If an attorney for the other side knowingly files a fraudulent sworn statement and the real one is found by accident and then it is proven that he knew....Is there case law that discusses damages and disposition of a case like this.

Probably. It's unlikely anyone is going to know the exact case citation off the top of his or her head, however.

Courts have inherent power to sanction parties and their counsel for contempt, which includes fraudulent representations. A case probably would not be dismissed if this were the only incident and sanction, but you should have an attorney check FL case law and advise on a serious matter like this.
