Legal Question in Construction Law in Florida
H2O damage
We are building a new house. We told our builder 2 months ago that the dining room window was leaking. They told us that they would take care of the problem. They still have not and now we have black mold growing on the walls, windowsills,basboards and tile floor. In addition the water is going through the wall into the laundry room and draining into the garage. What are our rights, does the builder have to replace drywall, insulation and anything else that may have mold due to the window leaking? Any advice would be great. We sent a letter to our builder about a week ago about this issue and stating that we would like drywall etc.. replace and we would also like a mold specialist to come out to see how much damage there really is. We have yet to hear from our builder.

By writing the letter you have already taken the first step in preserving evidence. Read Florida Chapter 558, regarding construction defects, and write the contractor pursuant to that statute. That should elicit a response. Otherwise, you may wish to consult with an attorney practicing in construction litigation. Good Luck.
