Legal Question in Construction Law in Florida
Home developer did not comply with walked through items
Dear Sir/s,
My wife and I purchased a condominium apt. prior to being finished. When we did the walked through last year on July 2001 we were promised those items will be fixed prior closing. It did not happened and then on the closing date we were given a warranty and the contractor was supposed to fix my home in a period of a year. I had many communications with them (verbal and written)but had no luck. Finally, on June this year they came to fix one of the items (batroom titles that were broken since we moved). They took the bathroom doorframe to replace and up to today they had let me without the frame they took my hammer and the developer is not trying to resolve.
Can you please help.
Thanks, sincerely

Re: Home developer did not comply with walked through items
Sorry to hear about your problem. Because I do not know all of the facts, I can only offer some general comments. It may be a good idea to speak with an attorney for specific legal advice.
This type of problem occurs quite often. Although you have a cause of action against the contractor, you may also have one against the party that sold you the condominium. Because you have already made reasonable attempts to settle this matter without success, you may unfortunately have to file a lawsuit.
In weighing your options, be sure to carefully examine all the paperwork to make sure you do not miss any deadlines. Also, keep a written record of any phone conversations you've had, and be sure to keep copies of all correspondence and proof of service.
Wish I could be a little more helpful, but it seems that you've already made your best efforts to resolve the matter. If you have any specific questions, please feel free to give me a call at (954) 229-1008. I'll be happy to speak with you at no charge. Best of luck!
