Legal Question in Construction Law in Florida
Intrest payments
My contractor and i had an agreement that he would build the house in 9 months by August 05. I have been paying intrest on the loan since he look the first draw in December 04. Since August it has been about 400.00 a month and the house is still not completed. Since he was supposed to be done by Aug. 1, 2005 can i sue him for this money since he was supposed to be done by August? The total is now about 1400.00? If so should i go through small claims court?

What you have is called "delay damages." If you have not made the final payment, then simply ask the contractor to adjust the bill due to the delays.
