If a construction company is in direct privity with the owner, is a Notice to Owner required?

RESPONSE: Notice to owners are used to secure lien rights. Generally, a notice to owner will not be required by the person who is in direct privity with the owner. To learn more about Notices to Owner review Florida Chapter 713 and especially 713.06 entitled liens of persons not in privity. Also review 713.01(18), 713.01(20), 713.04, 713.05, and 713.18.
