Legal Question in Construction Law in Florida
I had a painter paint my home. He did a horrible job. I found out that his license has been inactive for five years. My question.....if you are not licensed is it ok for you to put a sign in someone's yard that says you are licensed and insured? He did that. His sign was in my yard for over a week. I hope no one took down his number!

Painters are required to have special license in the State of Florida. If they are doing work without this license, by statute, you do not have to pay them. License must be active and current. You must have not known they were not licensed at the time of hiring them for the statute to apply. To answer your question, no it is not acceptable to advertise as licensed and insured if their license is not active. They could be reported to the Department of Business and Professional Regulation.
