Legal Question in Construction Law in Florida
Payment options when no notice to owner filed
I supplied materials to a church through a contractor. The church refused to pay the contractor so he is no longer in business and the church will not pay me. Do I have recourse if I did not file a notice to owner. It has been a year trying to collect this debt. Can I take the ADA signs off the building if they do not pay me? Can I visit the site and tell them that I will be removing them unless they pay me for them? Should I take them to small claims court? The value is over $3,000.00

Re: Payment options when no notice to owner filed
Because you are a subcontractor to the general contractor and did not enter into a direct contract with the owner, and because you failed to timely serve a Notice to Owner I do not see how you have any recourse against the owner.
Good luck in proceeding against the general contractor,
Randall Gilbert
