Legal Question in Construction Law in Florida
Property stolen from home in construction
I had a home built by a contractor, but did not use his company to put tile down in my home. I hired a local carpet and tile company to do the work and on the first night they left tile in the garage of the home and it was stolen. I ended up paying for the tile that was stolen because they threatened to lien the property and prevent me from closing. The house was not completely securable due to a broken lock on a sliding glass door.
The builder refused to pay because they said it wasn't their responsibility because it was not their workers or materials. The tile company refused to pay because they said that the home was not completely securable and did not know that the door was broken. I was not the owner yet because there had been no closing. Who is the responsible party, and if it is not me, how do i get my money back?
