Legal Question in Construction Law in Florida
If I purchased a new condominium unit from the developer and I intend to use the unit for commercial purposes (permitted in all condo agreements) and there are major construction defects (water/mold intrustion), can I still use Chapter 718's implied warranty rules? Or is 718's iimplied warranty rules only for condo owners that are using the units for residential purposes? Thanks in advance.

When you look at FL Statute Sec. 718.103, the definition of condominium does not distinguish between residential or commercial use. You are in the correct section for your issue.
