Legal Question in Construction Law in Florida
Roof work paid for and not completed
We paid $375 to a licensed roofer to repair a leak in our roof. The company has been out twice (the second time only after weeks of calls) and the leak is worse than before.
We filed a BBB complaint about 5 weeks ago, and they did not respond. I am now preparing to file a complaint against the roofer with the State of FL to get our money back.
Meanwhile, our roof is leaking... the rainy season is upon us, and we don't want a mold problem.
Can we go ahead and pay another roofer to finish the work, or should we wait until the State contacts the company about our complaint?

Re: Roof work paid for and not completed
Complaints to the BBB are usually worthless in my experience. Have another roofer look at the roof and get an estimate. Send the roofer a letter telling them the roof still leaks and receite the history. Let them know that if they don't fix it in a week, then you will hire someone to do so and then sue them. Then, if they don't fix it -- get it fixed and sue them. Tell the roofer to take lots of pictures of what they find to show that the prior roofer screwed up.
