Suing Contractor
If I fire and file a suit against my contractor will I have to wait until the suit is settled in court before I can hire another contractor to complete the development of my home.

You do not have to wait. There is a statute that deals with the exact steps you have to follow to terminate the notice of commencement and file a new one with your new contractor. The various building departments throughout the state have varying procedures on replacing a contractor on the permit and sometimes that can be a stumbling block, but it can be overcome.
